Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the services provided by Retarget Leads, a brand of BlackCheetah LLC (“Retarget Leads,” “we,” “us,” or “our”), including our AI receptionist, missed-call text-back, field service automation and related services (the “Service”), and our website at retargetlead.com.

1. Acceptance of these Terms

By using the Service, creating an account or subscribing to a plan, you agree to these Terms and to our Privacy Policy. If you are accepting these Terms for a business, you confirm that you have authority to bind that business.

2. The Service

The Service answers your business calls 24/7, qualifies callers, books appointments into your Google Calendar, and sends you text and email notifications, using your existing business phone number through call forwarding.

Plans and fees

• Starter: $97.00 per month
• Pro: $197.00 per month
• Elite: $297.00 per month
• Setup fee: a one-time setup fee of $495.00, charged when a paid subscription begins. It is covered by our 30-day money-back guarantee (see section 5).

Usage fees

• Call minutes: approximately $0.89 to $0.99 per minute, charged only for minutes above your plan’s monthly limit.
• Text notifications: $0.89 per text message sent to you.
• Appointment bookings: approximately $1.00 to $2.00 per booking. We do not currently charge this fee and will give you at least 30 days’ notice before we do.

3. Free trial

• The free trial includes up to 10 AI-answered calls within 7 days. No credit card is required to start.
• If you cancel during the trial, you pay no monthly fee, no setup fee and no trial usage fees.
• If you do not cancel, your account converts to the paid month-to-month plan you selected, and the setup fee is charged at that time.

4. Billing and payment

• Payments are processed by Stripe in U.S. dollars. You authorize us to charge your payment method for all fees.
• Monthly plan fees are billed in advance. Usage fees are billed monthly in arrears.
• If a payment fails, we may suspend or terminate the Service. You are responsible for any fees your bank charges.
• You are responsible for any applicable taxes.

5. 30-day money-back guarantee, cancellations and refunds

• 30-day money-back guarantee: If you are not 100% satisfied during the first 30 days of your paid subscription, contact us within those 30 days and we will refund 100% of what you paid, including the monthly plan fee, the setup fee and any usage fees. No questions asked.
• To request a refund, call or text 917-830-4090 or email info@retargetlead.com. Refunds go back to the original payment method.
• You can cancel at any time. Cancellation takes effect at the end of your current billing period, and there are no long-term contracts or cancellation fees.
• After the first 30 days of your paid subscription, fees already paid are not refundable, except for billing errors or service failures on our side.

6. Your responsibilities

• Keep your account details secure and give us accurate information.
• Do not use the Service for anything unlawful, deceptive, abusive or harmful, or to send unsolicited messages.
• Comply with all laws that apply to your business and communications, including the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act and state telemarketing and call-recording laws. You are responsible for any notices or consents required for calls, recordings and messages handled for your business.

7. SMS terms

Program: Retarget Leads sends service-related text messages to people who request information, start a free trial or use the Service, including replies to inquiries, setup and account updates, job and appointment notifications, and missed-call text-back messages sent on behalf of our business customers.

• Message frequency varies. Message and data rates may apply.
• Reply STOP to opt out at any time. You will receive one message confirming you have opted out. Reply HELP for help, or contact us at 917-830-4090 or info@retargetlead.com.
• Consent to receive text messages is not a condition of any purchase.
• Carriers are not liable for delayed or undelivered messages.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.

8. Our rights

• We may change or improve the Service. We will give you at least 30 days’ notice of any price change.
• We aim for 99.9% uptime but do not guarantee that the Service will be uninterrupted or error-free.
• We may suspend or terminate accounts for violations of these Terms, non-payment or fraud.

9. Intellectual property

The Service, including its software, scripts and design, belongs to Retarget Leads and its licensors. You keep ownership of your business data, customer information and calendar data, and you give us permission to use it only to provide the Service.

10. Data and privacy

We process business information, call recordings and transcripts, appointment data, messaging records, billing information and usage data to provide and improve the Service. Our Privacy Policy explains how we collect, use and protect this information.

11. Limitation of liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Retarget Leads is not liable for any indirect, incidental, special or consequential damages, lost profits, lost business or missed calls or appointments. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Indemnification

You agree to defend and indemnify Retarget Leads against claims arising from your use of the Service, your violation of these Terms or your violation of any law.

13. Disputes

These Terms are governed by the laws of the State of New York. Any dispute will be resolved by binding arbitration administered by the American Arbitration Association, except that either party may bring a claim in small claims court or seek injunctive relief to protect intellectual property. Claims must be brought individually, and you waive the right to participate in a class action.

14. General

These Terms are the entire agreement between you and us about the Service. We may update them, and we will email you about material changes. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Neither party is responsible for delays caused by events beyond its reasonable control.
